Using Lie Detector Tests in West Virginia

The use of lie detector tests by employers in West Virginia is subject to these state rules.

Employers in West Virginia may not require or request, either directly or indirectly, that an employee or prospective employee of the employer submit to a polygraph, lie detector or other similar test utilizing mechanical measures of physiological reactions to evaluate truthfulness.

In addition, an employer may not knowingly allow the results of an examination or test administered outside the state to be utilized for the purpose of determining whether to employ a prospective employee or to continue the employment of an employee in West Virginia.
