New Mexico Overtime Pay Law

Employers in New Mexico must conform with these state rules regarding overtime pay for employees.

In New Mexico, hours worked over 40 in any seven-day workweek must be paid at the rate of one and one-half times the regular hourly rate.

Exemptions From the General Overtime Provision

Specifically exempt from the overtime provisions are:

• employees who are engaged in cotton ginning for not more than 14 weeks a year; and
• employers of workers engaged in agriculture.
