Using Lie Detector Tests in Massachusetts

The use of lie detector tests by employers in Massachusetts is subject to these state rules.

It is unlawful for an employer in Massachusetts, with respect to any of its employees or prospective employees to subject the person to, or request the person to take, a lie detector test.

It is also prohibited for an employer to discharge, not hire, demote or otherwise discriminate against a person for the assertion of rights arising under this law.

Employment applications are required to contain the following notice that must be in clearly legible print:

"It is unlawful in Massachusetts to require or administer a lie detector test as a condition of employment or continued employment. An employer who violates this law shall be subject to criminal penalties and civil liability."
