Maine Overtime Pay Law
Employers in Maine must conform with these state rules regarding overtime pay for employees.
In Maine, work in excess of 40 hours in any one week must be compensated at a rate of one and one-half times the regular hourly rate.
Exemptions From the General Overtime Provision
The overtime pay requirements do not apply to:
- taxicab drivers
- certain homeworkers not subject to employer's supervision or control
- certain commissioned salespersons not subject to employer's supervision or control
- agricultural workers
- counselors under the age of 18 working for nonprofit organized camps
- switchboard operators in public telephone exchanges that have less than 750 stations
- members of the employer's family who reside with and are dependent upon the employer
- employees involved in the processing, marketing and storing of perishable goods, agricultural products, meat and fish products
- fishing industry employees
- mariners
- drivers and drivers' helpers not paid hourly and subject to federal motor carrier law
- automobile mechanics, parts clerks and salespeople
- bona fide executive, administrative, or professional capacity salaried employees with regular compensation, when converted to an annual rate, exceeds 3000 times the state's minimum hourly wage or the annualized rate established under the federal Fair Labor Standards Act (FLSA), whichever is higher
